1.  By accessing the service you agree to pay A$0.55 for each race update received for Australian mobile users and NZ$0.50 per SMS race update received for New Zealand mobile users.
2.  A signup fee will be charged of A$1.10 in Australia (2 x A$0.55 messages) and of NZ$1.00 in New Zealand (2 x NZ$0.50 messages).
3.  The frequency of race update messages is selected from the opt-in page on the website http://rolexsydneyhobart.com/ or by default set to race Updates every 4 hours. 
4.  Mobile users at any time can end their subscription by sending STOP to the short code. 
5.  The short code in Australia is 199774197 and in New Zealand is 3903.

7.  The Rolex Sydney Hobart Yacht Race SMS subscription service is available only for Australian and New Zealand mobile phone users.
8.  The Rolex Sydney Hobart Yacht Race SMS alerts will begin on 26 December 2009 shortly after 1.00pm (for Line Honours standings) and shortly after 4.00pm (for other standings) and will continue for the duration of the race or until a STOP message is sent to the short code.
9.  Race updates comprise the top three placings in the relevant category as at immedtely prior to the update.
10.  By subscribing to the service you agree to receive free messages containing information from Cruising Yacht Club of Australia (“CYCA”)
11.  The promotion is organized by BlueCentral Pty. Ltd. of Level 4, 6-8 Underwood Street, Sydney, NSW 2000 (“BlueCentral”) in conjunction with Cruising Yacht Club of Australia (“CYCA”)
12.  BlueCentral reserves the right to amend these Rules at any time.  Any changes will be posted within these Rules.
13.  In the event of any dispute regarding the Rules, conduct, results and all other matters relating to the access of the service, the decision of BlueCentral shall be final and no correspondence or discussion shall be entered into. 
14.  By using the service, you warrant that all information submitted by you is true, current and complete.
15.  BlueCentral assumes that by using its service (and you warrant that) either you have legal capacity to access the service and agree to the Rules (i.e. that you are of sufficient age and mental capacity and are entitled to be legally bound in contract) or your parents have consented to your accessing the service and use of these Rules.
16.  CYCA, Rolex SA and BlueCentral accept no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission or communications line failure, relating to the service.
17.  No refunds will be offered for any SMS that is not received or is not received correctly.
18.  By subscribing to the service you agree to permit BlueCentral to send free SMS messages to your mobile phone originating from any number or shortcode, for the purpose of allowing you access to the service.
19.  By subscribing to the service you warrant that the information which you submit does not infringe the intellectual property, privacy or any other rights of any third party, and will not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening.  If relevant, Blue Central reserves the right, but not the obligation, to screen, filter and/or monitor information provided by you and to edit, refuse to distribute or remove the same. 
20.  The Promotion and the terms and conditions of this agreement will be governed by New South Wales law.
